This article investigates the inclusion of environmental clauses in rural credit agreements, focusing on their legal effectiveness and the liability of financial institutions for environmentally harmful practices. The research using the hypothetical-deductive method and follows a qualitative approach based on literature review and critical analysis of legal doctrine, using Brazilian environmental legislation and the Forest Code as key normative frameworks. It begins by recognizing rural credit as a public policy tool for promoting sustainable development, analyzing its intersection with the socio-environmental function of rural property and contractual regulation. The paper then examines the nature, content, and limitations of environmental clauses in rural financing, emphasizing the role of financial institutions as sustainability drivers. The findings indicate the need to improve the design and enforceability of environmental contractual provisions to ensure their effectiveness and institutional accountability in complying with environmental norms. The study concludes by highlighting the urgency of a more robust and transparent legal model to foster legal certainty, environmental protection, and contractual fairness in rural credit operations.
